Moe Repair – Terms and Conditions

General Terms

1. Service Acceptance: All computers and equipment are accepted on an as-is basis. Service charges do not include costs associated with failing hardware unless specified.
2. Additional Services: Customers will be contacted via phone for approval before additional services are provided. Any additional services will incur extra charges.
3. Terms Changes: These terms are subject to change without prior notice. The customer’s agreement to the full terms and conditions is assumed upon the creation of a work order.
4. Right to Refuse Service: Moe Repair reserves the right to refuse any work order that violates these terms or is deemed unfeasible.

Payment Terms

1. Payment Due: Full payment is required at the time of pick-up or on-site delivery of repaired equipment.
2. Accepted Payment Methods: We accept payments via Visa, MasterCard, cash, business cheques, or certified cheques. Personal cheques are not accepted.
3. Applicable Taxes: All services, including hardware and software purchases, are subject to applicable taxes as required by law.
4. Mobile Payment Options: Authorized company technicians carry mobile payment devices for convenient payment processing.

Data Integrity and Recovery Disclaimer

1. Responsibility for Data: Moe Repair is not responsible for data loss during the repair process. Customers are strongly advised to back up their data prior to repair.
2. Data Recovery: While we use advanced equipment and software for data recovery, success is not guaranteed. Customers accept that data recovery attempts may result in partial recovery, complete failure, or additional damage to the storage device.
3. Limitation of Liability: By agreeing to the repair, customers release Moe Repair from liability for unrecovered or lost data.

Agreement of Non-Disclosure

1. Customer Privacy: Moe Repair will not access, view, copy, or disclose customer data unless required for the completion of the work order or by law.
2. Data Services Exception: Certain services, such as data recovery, transfer, or backup, may require access to customer data. Customers will be notified, and consent will be sought whenever possible.
3. Access Without Consent: If customer contact cannot be established and data access is necessary to complete repairs, Moe Repair reserves the right to proceed to ensure timely service completion.
4. Security Features: If required, Moe Repair may remove or bypass system security features, such as passwords, to complete repairs.

Spyware, Malware, and Virus Services

1. No Guarantee: Spyware, malware, and virus removal services cannot be guaranteed as re-infection depends on user behavior.
2. 30-Day Support: At our discretion, Moe Repair may offer free infection removal for up to 30 days after the initial service. This does not apply to recurring infections caused by user actions.

Equipment Recycling

1. Final Transactions: Any computers, components, or other equipment brought in for recycling are deemed final and cannot be returned to the customer.
2. Customer Responsibility: Customers must retrieve any data-containing devices, such as hard drives, before recycling is finalized. Pre-arranged retrieval can be made at no additional cost.
3. Data Wiping: Moe Repair will securely wipe functional media devices before recycling. Devices that fail to power up may not be wiped.
4. Defective Part Disposal: Old, defective parts are recycled at the time of equipment pick-up and cannot be retrieved later.

Limitations of Liability

1. Hardware and Software: Moe Repair is not liable for pre-existing hardware or software issues that are unrelated to the services provided.
2. Third-Party Products: Moe Repair is not responsible for compatibility issues with third-party hardware or software not supplied by us.
